Please read these terms carefully before using Open Learning Labs.

1. Acceptance of Terms
By downloading, installing, or using the Open Learning Labs application ("App") or visiting our website at openlearninglabs.com ("Website"), you agree to be bound by these Terms of Service. If you are a parent or guardian agreeing on behalf of a minor, you represent that you have the authority to bind them to these terms. If you do not agree, please do not use our services.
2. Description of Service
Open Learning Labs publishes free educational material for young learners ages 6–9: video lessons on this website, two games that run in the browser — a typing game and Learning Lab, a five-subject reasoning and practice game — and an iOS math app for Grades 2–3, which is coming to the App Store. Everything is free to use, and the first iOS build will include no in-app purchases, paid tiers, external payments, or paid unlocks.
3. Accounts and Data Control
The browser games have no accounts at all: progress is kept in your own browser, and each game's Grown-ups' Corner can export it or erase it. In the iOS app, sign-in is optional — Guest mode stores progress on the device, and signed-in users can sync progress across devices and delete their account at Settings > Account > Delete Account.
4. Intellectual Property
All content in the App and on the Website — including but not limited to text, graphics, logos, characters (Ava, Hannah, Kitty, and all pet companions), illustrations, animations, audio, video, software, and curriculum content — is the property of Open Learning Labs and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Our questions, explanations, and diagrams are written by us. Where we name a learning standard, we are citing a public document: the Texas Essential Knowledge and Skills (19 TAC Chapters 111, 110, 112, and 113), published by the Texas Education Agency, and the Common Core State Standards, published by the CCSSO and the NGA Center, are cited for alignment only and remain the property of their publishers. We do not reproduce practice questions from any other publisher.
5. Acceptable Use
You agree to use the App and Website only for their intended educational purpose. You may not: (a) attempt to reverse-engineer, decompile, or disassemble the App; (b) use the App for any commercial purpose without our consent; (c) attempt to circumvent any security or access controls; or (d) use the services in any way that violates applicable law.
6. Disclaimer of Warranties
The App and Website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Educational content is designed to supplement, not replace, formal schooling.
7. Limitation of Liability
To the maximum extent permitted by law, Open Learning Labs and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App or Website. Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated by updating the "Last updated" date on this page. Your continued use of the App or Website after such changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.
